Please read these terms carefully before using PathRoam

1. Acceptance of Terms

By accessing or using PathRoam (available at www.pathroam.co.za), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree to these terms, you are prohibited from using or accessing this service and must discontinue use immediately.

These Terms of Service constitute a legally binding agreement between you and PathRoam. Your continued use of the service following the posting of any changes to these terms constitutes your acceptance of those changes.

2. Description of Service

PathRoam is a web-based road trip planning platform designed primarily for travel throughout Southern Africa. The service provides tools and features to help users plan, organise, and share road trips, including but not limited to:

  • Interactive route planning and mapping
  • Stop and destination management along a route
  • Accommodation discovery and tracking
  • Travel cost estimation and budgeting tools
  • Packing and shopping list management
  • Trip collaboration and sharing with invited guests

PathRoam integrates with third-party mapping, routing, and location data providers to deliver these features. The accuracy and availability of third-party data is outside our direct control and is provided on a best-effort basis.

3. Accounts

To access most features of PathRoam, you must create an account. By registering, you agree to the following:

  • You must provide accurate, current, and complete information when creating your account and keep this information up to date.
  • You are solely responsible for maintaining the confidentiality of your account credentials, including your password, and for all activity that occurs under your account.
  • You may not share your account with another person or allow others to access the service through your account.
  • You may not create multiple accounts for the purpose of circumventing usage limits or account restrictions.
  • You must be at least 13 years of age to create an account and use PathRoam. If you are under 18, you should review these terms with a parent or guardian.
  • You must notify us immediately at support@pathroam.co.za if you suspect any unauthorised access to or use of your account.

We reserve the right to suspend or permanently terminate accounts that violate these Terms of Service, engage in fraudulent activity, or are otherwise used in a manner we consider harmful to other users or the service itself.

4. Subscriptions & Billing

PathRoam offers both a free tier and paid subscription plans. The following terms apply to all billing arrangements:

  • A free tier is available with limited features and usage quotas as described on the Pricing page.
  • Paid plans (Explorer and Adventurer) are available on monthly or annual billing cycles and are processed securely via Paystack.
  • All prices are displayed in South African Rand (ZAR) and are inclusive of any applicable taxes unless otherwise stated.
  • Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date.
  • You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access to your paid plan until the end of the current billing period, after which your account will revert to the free tier.
  • We do not offer refunds for partial billing periods or unused subscription time, except where required by applicable South African consumer protection law.
  • Promotional codes are subject to availability, have specific terms at the time of issue, and may have expiry dates. Each code may only be redeemed once per account.
  • We reserve the right to change subscription pricing at any time. Existing subscribers will receive reasonable advance notice of any price changes before they take effect.

5. Acceptable Use

You agree to use PathRoam only for lawful purposes and in a manner that does not infringe the rights of others or restrict their use and enjoyment of the service. You agree not to:

  • Abuse, overload, or intentionally interfere with the service, its servers, or the networks connected to it.
  • Scrape, crawl, index, or extract data from PathRoam by automated means without our prior written consent.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or organisation.
  • Upload, transmit, or distribute malicious code, viruses, malware, ransomware, or any other harmful or disruptive content.
  • Use the service for any unlawful purpose, including but not limited to activities that violate South African law or applicable international law.
  • Attempt to gain unauthorised access to any other user's account, data, or private content.
  • Reverse-engineer, decompile, or otherwise attempt to extract the source code of any part of PathRoam.
  • Use the service to send unsolicited communications (spam) to other users or third parties.

Violation of these acceptable use terms may result in immediate suspension or termination of your account without notice, and may be referred to relevant authorities where appropriate.

6. User Content

You retain full ownership of all content you create on PathRoam, including trip plans, stop details, itineraries, packing lists, shopping lists, notes, and any other data you input into the service.

By using PathRoam, you grant us a limited, non-exclusive, royalty-free licence to store, process, and display your content solely for the purpose of providing the service to you and the collaborators you explicitly invite to your trips. This licence does not extend to any commercial use of your content.

We do not sell, rent, or share your content with third parties for marketing or advertising purposes. Your content is used exclusively to deliver PathRoam's features to you.

You are responsible for ensuring that any content you upload or submit does not infringe third-party intellectual property rights, contain defamatory material, or otherwise violate applicable law.

7. Collaboration

PathRoam allows you to invite other registered users to collaborate on your trips. The following terms apply to collaborative features:

  • Collaborators may be granted editor or viewer access. Editors can view and modify trip data; viewers can only view it.
  • As the trip owner, you are responsible for managing who has access to your trips and for revoking access when appropriate.
  • You must only invite people who have consented to being added to your trip and receiving a related invitation email from PathRoam.
  • PathRoam is not responsible for any disputes between trip owners and their collaborators regarding access, data changes, or content.

8. Service Availability

We strive to keep PathRoam available, reliable, and performing well at all times. However, we do not guarantee uninterrupted, error-free, or continuously available service. Downtime may occur due to scheduled maintenance, infrastructure issues, third-party service outages, or events outside our control.

We reserve the right to modify, suspend, or permanently discontinue any feature or aspect of the service at any time. Where practicable, we will provide reasonable advance notice of significant changes or planned maintenance. We are not liable to you or any third party for any modification, suspension, or discontinuation of the service or any part thereof.

9. Limitation of Liability

PathRoam is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the fullest extent permitted by applicable law, PathRoam and its operators shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from your use of, or inability to use, the service — including but not limited to damages resulting from:

  • Decisions you make based on information provided by PathRoam, including trip planning, route selections, or accommodation choices.
  • Inaccurate, outdated, or incomplete data sourced from third-party mapping, routing, or accommodation data providers.
  • Loss of data, content, or trip information due to service interruption, account termination, or technical failure.
  • Unauthorised access to your account resulting from your failure to maintain the security of your credentials.

Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable South African consumer protection legislation, including the Consumer Protection Act 68 of 2008.

10. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law provisions. Any disputes arising out of or in connection with these terms, or your use of PathRoam, shall be subject to the exclusive jurisdiction of the courts of the Republic of South Africa.

If any provision of these terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

11. Changes to These Terms

We may update these Terms of Service from time to time to reflect changes to our service, legal requirements, or business practices. The "Last updated" date at the top of this page will always reflect when the terms were most recently revised.

For material changes, we will make reasonable efforts to notify you — for example, by displaying a notice within the application or by sending an email to the address associated with your account. Your continued use of PathRoam after any changes have been posted constitutes your acceptance of the updated terms. If you do not agree to the revised terms, you must stop using the service.
